Terms and Conditions

These Terms and Conditions govern the provision of videography, photography, and drone services provided by jamoodyphotography ("Service Provider") to you ("Client"). By booking our services, the Client agrees to be bound by these Terms and Conditions.

"Services" refer to videography, photography, and drone footage as agreed upon by the Service Provider and the Client. "Client" refers to any individual, company, or entity that enters into a contract with the Service Provider for the provision of Services.

Scope of Work: The specific details of the Services to be provided will be outlined in each project proposal or contract.

Contract Formation: A contract is considered formed when the Client accepts a proposal from the Service Provider and signs or agrees to a service agreement.

Deposits and Payments: A deposit may or may not be required to secure the Services, with the final balance due by the end of the business day following the event or service date. Payments can be made via [Cash, Check.]

Late Payments and Chargebacks: In addition to the service amount, a late fee may be incurred if a due date laspes, unless otherwise agreed. If payments are not made or a chargeback incurs legal actions may be taken against the Client and or denial of future services.

Cancellation Policy: Cancellations must be made 1 day prior to the event. Cancellations made after this period must pay the full-service amount. Unless otherwise agreed.

Rescheduling: Rescheduling is subject to availability and may incur additional charges if made before the scheduled date.

Rights and Responsibilities

Client Responsibilities: The Client is responsible for securing access to venues, obtaining necessary permissions for photography/videography, and ensuring cooperation during sessions.

Service Provider Responsibilities: The Service Provider will conduct the Services in a professional manner, adhering to timelines agreed upon in the contract.

Intellectual Property: The Service Provider retains copyright over all images and footage. The Client is granted usage rights for personal or promotional purposes as agreed.

Usage Rights: Unless otherwise agreed, the Service Provider retains the right to use any images or footage for their own promotional purposes.

Drone Rights

Regulatory Compliance: All drone operations will comply with aviation laws and regulations.

Services may be rescheduled due to adverse weather conditions at the discretion of the Service Provider.

Drone services will be conducted ensuring the utmost safety and may be canceled or postponed if safety concerns arise.

Liability and Indemnification

Limitation of Liability: The Service Provider is not liable for any indirect, special, or consequential loss or damage arising under these Terms and Conditions or in connection with the Services provided.

Indemnification: The Client agrees to indemnify the Service Provider against any claims arising from the unauthorized use of the material or violation of these terms.

Dispute Resolution

Any disputes will be resolved via mediation, followed by arbitration if necessary, before resorting to legal proceedings. Unless otherwise agreed.

Miscellaneous

If any part of these Terms and Conditions is held invalid or unenforceable, the remaining portions will remain in full force and effect.

These Terms and Conditions may only be amended in writing signed by both parties.

Access to files WILL ONLY be granted after payment is made unless otherwise agreed.
